ACCEPTABLE USE
POLICY (AUP)
- You are
prohibited from posting any unlawful, libelous, threatening,
abusive, disruptive, or obscene material or message that
would violate the rights of any person or constitute a
criminal offense, or otherwise violate any local, state,
national, or international law. Use of eCommunityGuide for
advertising or promotion of a commercial product or service
without the express, written consent of eCommunityGuide is
prohibited.
- You are
prohibited from uploading or reproducing any information
protected by copyright without obtaining permission of the
copyright owner. Only public domain files, and files in
which the author has given you express consent to copy and
redistribute online or otherwise, may be uploaded to
eCommunityGuide, including any software files or libraries.
- Information
and materials, which you find published on eCommunityGuide,
may be the property of eCommunityGuide or an Information
Provider, and may be protected by copyright or may contain
protected trademarks. You may not copy, redistribute or
commercially exploit such materials without the express
written permission of the owner(s) of such information or
materials.

eCommunityGuide reserves the right to remove ANY messages
from the eCommunityGuide Bulletin Board System if it
believes, in its sole discretion, that you have violated any
of the Rules of Online Behavior. eCommunityGuide will not be
held liable, in any way, for material posted to the
eCommunityGuide Bulletin Board System or any of its other
interactive components.
REPRESENTATIONS,
WARRANTIES AND ACKNOWLEDGEMENT
- You warrant
that all material that you submit for publication or posting
on eCommunityGuide will not violate or infringe any
copyright, trademark, patent, statutory, common law or
proprietary rights of others, or contain anything obscene or
libelous. By submitting information or materials owned by
you for publication or posting on, or distribution through,
eCommunityGuide, you will be deemed to have granted
eCommunityGuide non-exclusive permission to redistribute by
transmission the information or materials worldwide without
charge or liability. eCommunityGuide reserves the right, in
its sole discretion, but is under no obligation, to refuse
to post, delete or edit information that you submit or enter
onto the eCommunityGuide Bulletin Board System, including
but not limited to electronic message boards, databases, and
calendars. You agree that you will not hold, nor seek to
hold, eCommunityGuide liable for the loss of data or the
misappropriation or infringement of any intellectual
property right to which you claim ownership.
ECOMMUNITYGUIDE IS
PROVIDED ON AN "AS IS, AS AVAILABLE" BASIS. NO WARRANTIES,
EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THOSE OF
MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE MADE
WITH RESPECT TO ECOMMUNITYGUIDE OR ANY INFORMATION OR SOFTWARE
THEREIN. UNDER NO CIRCUMSTANCES, INCLUDING NEGLIGENCE, SHALL
ECOMMUNITYGUIDE BE LIABLE FOR ANY INCIDENTAL, SPECIAL, OR
CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OF OR INABILITY
TO USE THE ECOMMUNITYGUIDE BULLETIN BOARD SYSTEM. NOR SHALL
ECOMMUNITYGUIDE BE RESPONSIBLE FOR ANY DAMAGES WHATSOEVER THAT
RESULT FROM MISTAKES, OMISSIONS, INTERRUPTIONS, DELETION OF
FILES, ERRORS, DEFECTS, DELAYS IN OPERATION OR TRANSMISSION,
OR ANY FAILURE OF PERFORMANCE WHETHER OR NOT CAUSED BY EVENTS
BEYOND ECOMMUNITYGUIDE’S REASONABLE CONTROL, INCLUDING BUT NOT
LIMITED TO ACTS OF GOD, COMMUNICATIONS LINE FAILURE, THEFT,
DESTRUCTION, OR UNAUTHORIZED ACCESS TO ECOMMUNITYGUIDE
RECORDS, PROGRAMS, OR SERVICES. IN NO EVENT SHALL
ECOMMUNITYGUIDE’S TOTAL LIABILITY FOR ALL DAMAGES, LOSSES, AND
CAUSES OF ACTION EXCEED THE AGGREGATE DOLLAR AMOUNT PAID UNDER
THE AGREEMENT. SOME STATES DO NOT ALLOW THE LIMITATION OR
EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL
DAMAGES; AS A RESULT, THE ABOVE LIMITATION OR EXCLUSION MAY
NOT APPLY TO YOU.

You acknowledge that eCommunityGuide has the right to delete
any of your personal files or messages on the
eCommunityGuide service, which have not been accessed for
more than one month.
- You agree to
indemnify and hold eCommunityGuide, its parents,
subsidiaries, officers and employees, harmless from any
claims and expenses, including reasonable attorney's fees,
related to your violation of this Agreement, including any
abusive or unlawful behavior on the part of you or your
dependents, or the infringement of any intellectual property
or privacy right of any person.

eCommunityGuide reserves the right to modify this agreement
at any time.
- This
Agreement will be governed by and construed in accordance
with the Laws of the State of Massachusetts.
- By posting
material or content to eCommunityGuide, you are agreeing to
the terms set fourth in this agreement.
